Texas-based Tesla Inc. is one of a small but growing number of U.S. companies offering to cover travel costs for employees who must cross state lines for medical care, including abortion.

The companies are offering these benefits as the state and federal abortion policy landscape in the United States is changing. Texas implemented the nation’s toughest abortion law last November when it banned abortion after six weeks of pregnancy and delegated citizens to enforce the rule. Other states including Idaho, Florida and Oklahoma have passed laws tightening access to the process in recent months.

Earlier this week, a leaked Supreme Court draft opinion indicated that the court may be preparing to overturn Roe v. Wade, the 1973 precedent that established a constitutional right to abortion.

The 67-page draft, first reported Monday by Politico, said Roe was “grossly false and deeply damaging.”

Chief Justice John Roberts said in a statement Tuesday that the draft, drafted in February, was not necessarily the final resolution of the case. The court is expected to deliver its opinion in late June or early July.


If Roe v. Wade is overruled, it would open the door to tougher state restrictions, including procedural bans.

Companies offering to help employees travel for abortions may be on safe legal ground at the moment, but that could change.

Texas abortion law extends liability to abortion clinics and physicians, as well as those who assist in abortions. Oklahoma and Idaho have passed similar legislation. Oklahoma Governor Kevin Stitt signed the law into law this week, and the Idaho law has been temporarily stalled in court. Some lawmakers, meanwhile, pushed back on the company’s new policies.

Tesla, TSLA -0.87%▼, which announced the move of its headquarters last October to Austin, Texas, said in its 2021 “Impact Report” that the company has an “offer of extended health insurance which includes travel and accommodation assistance for those who may need to seek health services that are not available in their home country.” Tesla did not respond to a request for comment on Friday.

Amazon Inc., headquartered in Seattle, told employees it would reimburse up to $4,000 a year for travel expenses for medical treatment, including abortions, which employees cannot access within 100 miles of their home.
